- Introduction
Raqmana Platform (hereinafter referred to as the “Platform”) is a specialized electronic platform owned and operated by Raqmana Tech (hereinafter referred to as the “Company”), a company established in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia, with Unified National Number 7054194324 dated 28/04/2026.
These Terms and Conditions have been established to govern the contractual relationship between the Company and any individual who uses, registers on, or benefits from the Platform’s services (hereinafter referred to as the “User”), and to define the rights and obligations arising for each party.
The User is required to carefully review these Terms and Conditions before using the Platform or creating an account. By using or registering on the Platform, the User expressly acknowledges and agrees to these Terms and Conditions and undertakes to comply with all provisions contained herein.
If the User does not agree to any provision of this document, they must refrain from using the Platform or any of its services.
- Definitions
For the purposes of these Terms and Conditions, the following terms and expressions shall have the meanings assigned to them below wherever they appear in this document, unless the context requires otherwise:
- User: Any natural or legal person who registers on, accesses, uses, or benefits from any of the Platform’s services by any means whatsoever.
- Platform: The electronic platform operated by the Company, including its website and related applications, used to display real estate opportunities and products and to enable users to interact with or invest in them.
- Company: Raqmana Tech, a closed joint-stock company registered in the Kingdom of Saudi Arabia under Unified National Number 7054194324, and the entity that owns, operates, and manages the Platform.
- Account: The User’s electronic account on the Platform, through which access to services and various transactions is carried out.
- Wallet: An electronic account linked to the User’s account, through which financial balances and purchase and investment transactions are managed, enabling the User to deposit funds and use them to complete transactions the Platform.
- Real Estate Opportunity: Any product or offering made available through the Platform that enables Users to subscribe to, invest in, or benefit from the returns of a real estate asset for the purpose of generating periodic income or capital gains, including various real estate investment structures.
- Fractional Ownership: An investment model that allows the User to own a specified share in an income-generating property, whether documented through the real estate registry or contractually documented, entitling the User to receive a proportionate share of rental income and capital gains resulting from the sale or liquidation of the property, in accordance with the governing terms and conditions.
- Usufruct Right: A right that grants a group of Users the ability to benefit from the use and returns of a specific property for a defined period without owning the underlying asset, with such benefits and returns distributed among them according to each User’s contribution share.
- Share Value: The financial value of a share or portion of the real estate asset, fractional deed, or token, including any associated fees or costs.
- Returns: The revenues or profits generated from the operation or investment of the real estate asset, which are distributed among participating Users or owners in proportion to their respective shares.
- Trading: The buying and selling transactions conducted on shares or rights associated with real estate opportunities within the secondary market made available through the Platform.
- Token: A digital unit representing a share or right in a real estate asset, electronically documented in a manner that enables its ownership to be transferred or traded in accordance with applicable laws and regulations.
- Liquidation: The termination of a real estate opportunity or its associated investment entity, including the sale of assets and distribution of net proceeds to the owners or participants.
- Exit: The User’s complete withdrawal from an investment through the sale, liquidation, or any other approved method of disposing of their share.
- Kingdom: The Kingdom of Saudi Arabia.
- Authority: The Real Estate General Authority.
- Regulatory Authorities: The competent governmental authorities responsible for regulating real estate or financial activities in the Kingdom of Saudi Arabia.
- Services Provided
The Platform provides a range of services related to real estate activities, including the following:
- Displaying and making available real estate investment opportunities through the Platform after being studied and evaluated by the Company.
- Providing innovative and diverse real estate investment models and products tailored to meet the varying needs of Users.
- Enabling Users to manage and monitor their real estate investments through dedicated electronic tools.
- Calculating, managing, and distributing returns generated from real estate investments in accordance with participation ratios.
- Organizing and managing exit, liquidation, and transfer procedures relating to investment shares in accordance with the approved mechanisms.
- Providing support and assistance services, including periodic reports and related advisory services.
- Real Estate Opportunities
First: Nature and Management of Real Estate Opportunities
- The Platform offers a variety of real estate investment opportunities that differ in type, category, and structure, providing Users with multiple participation options.
- Each real estate opportunity is subject, prior to listing, to review and analysis procedures in accordance with the Company’s internal standards. Depending on the nature of the opportunity, such procedures may include real estate valuation, verification of legal ownership validity, as well as financial and economic studies and other related assessments.
- The Platform provides explanatory data and information for each real estate opportunity, including its description, characteristics, investment mechanism, expected returns, as well as the potential risks associated with it.
- The information provided and any estimated returns shall not be considered a guarantee of actual profits, and the Company assumes no obligation regarding the realization of such returns.
- The User acknowledges and agrees that the Company, or any party authorized by it, shall manage all matters related to the investment property, including making operational and investment decisions such as appointing property managers, carrying out maintenance works, and making decisions related to sale or exit.
- The User shall not have the right to interfere in the management of the property or obstruct decisions relating thereto, nor shall the User have the right to object to any sale or disposal procedures, except within the limits provided under the voting mechanisms approved for each opportunity, which shall be determined based on majority approval and in accordance with the applicable regulatory requirements.
- The relationship between the User and the Company shall be limited to what is expressly set out in these Terms and any documents relating to the relevant real estate opportunity. The User shall have no right to obligate the Company to undertake any additional actions or require prior approval for any disposition unless expressly stated otherwise. Furthermore, the User may not directly communicate with tenants or take any legal action against them except through, or with the approval of, the Company.
- The User is prohibited from disposing of their share, whether through sale, transfer, or otherwise, except through the approved channels available on the Platform and in accordance with the applicable governing mechanisms.
Second: Subscription to Real Estate Opportunities
- The Platform enables Users to participate in real estate opportunities in accordance with the structure applicable to each opportunity and in compliance with the laws and regulations in force in the Kingdom.
- The minimum participation amount for each opportunity shall be determined according to its nature and regulatory requirements. As a general guideline, the minimum subscription amount starts from SAR 1,000 unless otherwise specified.
- Subscription to any real estate opportunity shall constitute a final and binding commitment, and may not be revoked nor shall any refund request be made after completion of the subscription process.
- The relationship between the User and the other relevant parties shall be governed in accordance with the approved legal structure of each opportunity and in compliance with the applicable laws and regulations.
- The User’s rights and obligations shall primarily be subject to the specific terms of each real estate opportunity, which are disclosed in advance. Reviewing and accepting such terms shall be a prerequisite for participating in the relevant opportunity.
Third: Real Estate Opportunity Documents
- A dedicated document shall be prepared for each real estate opportunity offered through the Platform.
- Such document shall include all material details relating to the opportunity, including the participation mechanism, rights and obligations, risks, and the relevant financial and operational aspects.
- The User shall be responsible for carefully reviewing such document before making any investment decision, and participation in the opportunity shall constitute the User’s acknowledgment that they have read, understood, and agreed to its contents.
- Terms of Use and Eligibility
First: Rules of Use
- The User shall ensure that their use of the Platform is limited to lawful purposes and conducted in compliance with the laws and regulations applicable in the Kingdom of Saudi Arabia and the provisions of these Terms.
- The User must refrain from any use that may affect the stability or operational efficiency of the Platform, including any actions that may disrupt, damage, or impair its systems or services in any manner whatsoever.
- The Platform may not be used for any unlawful activity or any conduct involving fraud, deception, misuse, or any act that may result in direct or indirect harm to the Company, other Users, or any third party.
- The User shall provide true and accurate information and is prohibited from impersonating any person or entity, or falsely implying the existence of any relationship or affiliation with any party.
- يThe User is prohibited from accessing, collecting, storing, or using any data or information relating to other Users outside the scope expressly authorized or in violation of the applicable laws and regulations.
. - In the event of a breach of any of the above obligations, the User shall bear full legal and financial responsibility arising therefrom and shall have no right to bring any claims or seek compensation against the Company. The User shall also be responsible for all damages or costs resulting from such violation.
Second: Eligibility
- To benefit from the Platform’s services, the User must possess full legal capacity in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia.
- For natural persons, the User must have reached the legal age (18 years old), possess full legal capacity to act, and be legally authorized to own, benefit from, or lease real estate in accordance with the applicable laws and regulations and the conditions of each real estate opportunity, including any restrictions applicable to non-Saudis.
- For legal entities, the entity must be duly established or licensed in accordance with applicable laws and must have the right to conduct activities related to real estate within the Kingdom. Dealings with the Platform must be carried out through an authorized representative possessing the necessary legal authority.
- Registration and Account Creation
First: Account Creation and Registration Requirements
- Use of the Platform’s services requires the User to create an electronic account by completing the required information accurately and correctly, and the User shall be responsible for the accuracy of such information.
- Registration information includes, without limitation, the User’s full name, national ID or residency number, contact details such as phone number and email address, in addition to any other information that may be required by the Platform depending on the nature of the service.
- The Company may request additional documents or information to verify the User’s identity for the purpose of complying with applicable legal and regulatory requirements, including Know Your Customer (KYC) and Anti-Money Laundering (AML) requirements.
Second: User Obligations Regarding the Account
- The User shall maintain the confidentiality of their login credentials, including the username and password, and shall not share them with any third party.
- The User must immediately notify the Company upon becoming aware of any unauthorized use of their account or upon suspecting any security breach or unlawful activity associated with it.
- The User shall bear full responsibility for all transactions or actions carried out through their account, whether conducted with or without their knowledge, unless otherwise proven in accordance with the applicable laws and regulations.
- The User shall continuously update the information registered with the Platform in the event of any changes thereto, in order to ensure its accuracy and completeness.
Third: Company Authority Regarding Accounts
- The Company shall have the right, at its sole discretion and without prior notice, to suspend, restrict, or terminate an account temporarily or permanently in any circumstances deemed necessary to protect the Platform or its Users. Such circumstances include, without limitation, providing false or incomplete information, violating these Terms or any supplementary agreements, or using the Platform in an unlawful, fraudulent, or abusive manner.
- The aforementioned measures may also be taken pursuant to a request or directive issued by a competent judicial or regulatory authority, or in the event that the account remains inactive for an extended period of time (subject to notifying the User prior to cancellation whenever reasonably possible).
- The Company may also take any measures it deems appropriate in any other situation where it determines that there are risks to the Platform, its Users, or the integrity of its operations.
- Returns, Management, and Liquidation
First: Management and Operation of Real Estate Opportunities
- Pursuant to these Terms, the User agrees to entrust the management and operation of the investment property to the Company, in its capacity as the entity responsible for overseeing all operational and investment aspects related thereto.
- Management activities include, without limitation, regulating relationships with tenants, preparing, documenting, and amending lease agreements, collecting revenues, settling operational obligations, contracting with maintenance and facility management service providers, activating relevant systems, and managing financial flows related to the property. The Company may also appoint third parties to perform certain management functions as it deems appropriate.
- The Company shall be entitled to compensation for its services in managing the real estate opportunity, whether in the form of periodic fees or a percentage of the generated income. Such compensation shall be specified in detail in the relevant real estate opportunity document or agreement and shall be deemed payable and deductible from revenues prior to their distribution.
Second: Returns and Distribution Mechanism
- Returns generated from the operation or investment of the property shall be calculated and distributed to Users in accordance with the ratios and distribution mechanism specified for each real estate opportunity.
- The timing and nature of return distributions shall be subject to the disclosures set out in the opportunity document, and nothing therein shall constitute a guarantee of achieving specific returns.
- Financial entitlements shall be transferred to the User’s approved bank account after completion of all relevant requirements and procedures.
- Returns shall be subject to taxes, fees, and any costs associated with payment or transfer services in accordance with the laws and regulations applicable in the Kingdom, and such amounts may be deducted, as applicable, before or during the distribution process.
Third: Termination of Real Estate Opportunities and Exit
- The investment term and the mechanism for liquidation of the opportunity shall be specified in its dedicated document, according to the nature of its investment structure.
- The opportunity may terminate through the sale of the asset, its restructuring, or any other approved method, upon which the net proceeds shall be distributed to Users after deduction of expenses and obligations associated with the liquidation process.
- The Company may, whenever it deems that such action serves the interest of the opportunity or the Users, extend the duration of the real estate opportunity in accordance with the controls and procedures specified in the opportunity document.
- Any exit prior to the expiration of the opportunity term shall be subject to the governing conditions applicable thereto, whether through the secondary market or any other mechanism, in accordance with the laws, regulations, and instructions issued by the competent authorities.
- Mechanisms or channels for exit from certain real estate opportunities may be made available during specified periods and in accordance with the controls and instructions issued by the competent regulatory authorities. Where such mechanisms are available, the User may dispose of their share exclusively through the approved channels.
- Any disposal of shares or real estate rights shall be subject to the payment of all applicable statutory fees, including registration fees and applicable taxes, in addition to brokerage fees or any other charges specified for each opportunity separately.
- The User acknowledges and agrees to appoint the Platform as the exclusive intermediary for completing any sale or exit transactions conducted through it. The Platform shall be entitled to the agreed fees as disclosed in the opportunity document or its approved policies, whether payable by the seller or the buyer, as determined by the Platform for each case.
- Fees and Payments
First: Types of Fees
The Company shall be entitled to financial compensation for the services provided through the Platform. Fees shall be determined according to the nature of each service or real estate opportunity and may include the following:
- Subscription Fees: Fees imposed upon the User’s entry into or participation in any real estate opportunity, payable as a one-time charge upon completion of the subscription process.
- Platform Brokerage Fees: Fees relating to brokerage, arrangement, or making opportunities available to Users through the Platform, in consideration for organizing the opportunity or facilitating participation therein.
- Annual Property Management Fees: Fees related to the operation and management of the property, including maintenance services, fees for documenting contracts through the Ejar platform, homeowners association fees, and the fees of the property manager or facility manager.
- Real Estate Registry Fees: Governmental fees payable upon the registration or transfer of ownership or any real estate disposition, to be borne by the disposing party in accordance with the applicable laws and regulations.
- Real Estate Transaction Tax: A tax imposed on the value of any real estate transaction in accordance with the tax laws and regulations applicable in the Kingdom.
- Annual Administrative Fees: Fees payable in consideration for managing and supervising the real estate opportunity, in addition to the management and operation of the Platform.
- Liquidation or Exit Fees: Fees imposed in consideration for managing the procedures related to the termination of the real estate opportunity or final exit, including organizing the sale process or liquidation of assets.
- Early Exit Fees: Fees applicable where the User wishes to terminate their participation prior to the expiration of the opportunity term, including the costs of arranging the sale process or locating a replacement party.
- Transfer Fees: Fees imposed when the User transfers or assigns their share to a third party, subject to the Platform’s approval and in accordance with the approved procedures.
Second: Determination and Regulation of Fees
- The value, rates, and calculation mechanism of the fees shall be specified in detail in the document of each real estate opportunity or in the relevant approved policies, and such provisions shall constitute an integral part of these Terms.
- The Company reserves the right to amend existing fees or introduce new fees from time to time, provided that Users are notified in advance through the Platform. Such amendments shall take effect as of the date specified by the Company.
- The Platform enables Users to review the details of applicable fees and any updates thereto through the official channels made available within the Platform.
- Operational or procedural fees may be imposed on certain transactions, such as deposit, withdrawal, or balance management transactions, in accordance with the disclosures provided at the time such transactions are carried out.
Third: Payment Methods and Financial Provisions
- All amounts due shall be paid using the payment methods approved by the Platform, which may include bank transfers, electronic payment methods, or any other methods approved by the Company.
- All payments shall be made in Saudi Riyals (SAR), unless otherwise specified in certain cases.
- The User shall bear all fees and commissions associated with payment or transfer transactions, including bank charges, payment service provider fees, or any other related costs.
- If any payment transaction is not completed for any reason whatsoever, the Company shall have the right to cancel the relevant transaction or request without incurring any liability.
- The Company may amend or update its approved payment methods or financial procedures at any time, and such amendments shall apply to subsequent transactions from the date they are announced through the Platform.
- The Company is authorized, to the extent required for operational purposes, to undertake the financial procedures necessary to complete transactions related to real estate opportunities, including payment of real estate registry fees, real estate transaction tax, and the value of the property or ownership share subject to acquisition, provided that such transactions are documented in a manner that preserves the User’s rights in accordance with the applicable laws and regulations.
- Risks and Disclosures
- The User acknowledges that investment in real estate opportunities inherently involves a degree of risk and may be subject to fluctuations affecting the value of the investment or its expected returns, including changes in market prices, limited liquidity and the difficulty of liquidating real estate assets within short periods, in addition to risks associated with the management and operation of real estate properties.
- Risks also include economic, regulatory, or political factors that may affect the real estate sector, as well as financing obligations associated with the property, if any, and changes in laws or taxes that may impact the performance or cost of the investment.
- The User acknowledges and agrees that any information or projections relating to returns or performance are inherently estimative in nature and do not in any way constitute a guarantee of actual profits. Furthermore, the past performance of any opportunity or product shall not be considered an indication of future results.
- The User shall bear responsibility for evaluating their financial position and the suitability of the investment for them, and for making their investment decision based on their own judgment, without relying on the Platform as an advisory entity.
- The Company shall not bear any liability for losses or damages that may arise from investment in real estate opportunities, unless such losses or damages result from the Company’s gross negligence or willful misconduct as established in accordance with the applicable laws and regulations.
- The Company shall undertake to provide material information relating to each real estate opportunity, including key data, influencing factors, and associated risks. The Company shall also disclose, where applicable, any situations in which conflicts of interest may arise that could affect its impartiality or decision-making.
- The User’s review of the real estate opportunity document and understanding of all its details, including the terms, obligations, and risks, shall constitute an essential prerequisite before making any participation decision. Participation in any opportunity shall be deemed an acknowledgment thereof by the User.
- Liability and Indemnification
First: Limitation of Liability
- The Platform operates as a licensed technology entity authorized to conduct real estate brokerage and marketing activities. Its role is limited to making opportunities available and connecting Users with the relevant parties. The Platform shall not be deemed an investment or financial entity and does not provide any investment or financial advice of any kind.
- The information relating to real estate opportunities is provided for illustrative purposes only. Although the Company undertakes reasonable measures to verify such information, it makes no representations or warranties—whether express or implied—regarding its accuracy, completeness, or reliability, nor does it guarantee the achievement of any returns or the preservation of investment value.
- The Company shall not bear any liability for the acts, omissions, or breaches of any third party, including property owners, tenants, property managers, or service providers, nor does it guarantee the accuracy or correctness of any information issued by them.
- The User acknowledges that investment in real estate opportunities involves risks and shall solely bear the consequences of their investment decisions, including any financial losses, decrease in value, failure to achieve expected returns, or loss of capital.
- The Company shall not be liable for any indirect, consequential, incidental, or special damages, including, by way of example, loss of profits, opportunities, data, or reputation, even if advised of the possibility of such damages.
- The Company does not guarantee the continuous, uninterrupted operation of the platform, and shall not be liable for any losses arising from service downtime or failure, whether due to maintenance, updates, technical faults, communication issues, or any circumstances beyond its control.
- In all cases, the total financial liability of the Company – if any – towards the user shall not exceed the value of the fees paid by the user to the platform during the twelve (12) months preceding the incident giving rise to the claim, and this limit is considered the maximum possible compensation without any exception.
Second – Compensation
The user undertakes to indemnify, defend, and hold harmless the Company, as well as its officers, directors, employees, and agents, from any claims, lawsuits, losses, damages, or costs (including attorney fees) arising from or directly or indirectly related to the following:
- Any violation by the user of the provisions of these terms or any related agreements.
- Misuse of the platform or using it in an unauthorized manner.
- Violation of any third-party rights, including contractual, legal, or intellectual property rights.
- Breach of any of the applicable laws or regulations in the Kingdom of Saudi Arabia.
- Zakat and Taxes
- The user bears full responsibility for calculating and paying the Zakat due on their funds and investments, including real estate shares and the returns generated from them, and the platform bears no obligation or liability in this regard.
- All fees and services provided through the platform are subject to Value Added Tax (VAT) – where applicable – and the user is responsible for its payment, provided that the platform collects and remits it to the competent authority in accordance with the applicable laws and instructions.
- The user also bears any other taxes that may apply to them, including taxes related to income, capital gains, or any tax obligations arising from their legal or tax status, whether inside or outside the Kingdom, and the platform shall not have any role or responsibility in this matter.
- The user is obligated – whenever required – to register with the competent Zakat or tax authorities, submit the required returns within their legal deadlines, pay the dues incurred by them, and maintain the records and data necessary to prove their compliance.
- The platform is committed, within the limits of the law, to issuing the required invoices or financial documents and providing data related to the transactions conducted by the user through it. It may also provide the competent authorities with the required information in accordance with the regulations in force.
- The platform does not provide any Zakat or tax advice, and any information that may be understood as guidance in this regard shall not be relied upon. The user alone is responsible for verifying…
- User Representations and Warranties
First – Eligibility, Legal and Financial Capacity
- The user represents that they possess full legal capacity to enter into contracts and fulfill the resulting obligations, and that they have the necessary authorities to act either on their own behalf or as an authorized representative for any other party.
- They also represent their financial capacity to fulfill all obligations arising from their use of the platform or participation in real estate opportunities.
- The user confirms that they have not previously been barred from using the platform, or had their account suspended or access restricted for any reason.
Second – Accuracy of Data and Commitment to Update
- The user is committed to ensuring that all data and information they provide, enter, or share through the platform is correct, accurate, and up-to-date, and they bear full responsibility for any deficiency, error, or misleading content therein.
- The user must update their data immediately upon any change occurring to ensure its continued accuracy and correctness.
- The user acknowledges their full review of these Terms and Conditions and the Privacy Policy, their understanding of them, and their agreement to them without restriction or reservation.
Third – Account Security and Confidentiality of Information
- The user is committed to maintaining the confidentiality of their login data and not disclosing it or enabling any third party to use it.
- They must notify the Company immediately upon discovering any unauthorized use of their account or any security breach or illegal activity.
- The user also commits not to use any information obtained through the platform except within the limits of legitimate use, and not to exploit it for any commercial or illegal purposes.
Fourth – Usage Controls and Legal Compliance
- The user is committed to using the platform in accordance with the applicable laws and regulations, and in a manner that does not prejudice its intended purpose.
- The user shall refrain from any use involving fraud, misuse, impersonation of others, or providing incorrect or misleading information.
- The user may not attempt unauthorized access to the platform’s systems, interfere with its operation, or cause damage to it by any means whatsoever.
- The user also commits not to create or use multiple accounts for the purpose of circumventing the platform’s policies or terms.
Fifth – Risk Disclosures and Liability
- The user acknowledges their awareness of the nature of the risks associated with investing in the real estate sector, and that their investment decisions are made based on their personal judgment and without reliance on any guarantees from the platform.
- They also acknowledge that the platform does not represent a financial or investment advisory body to them, and that they alone bear the results of their investment decisions.
- The user bears full responsibility for any financial losses or consequences resulting from their use of the platform or participation in real estate opportunities.
- They also acknowledge their responsibility for verifying the validity of the financial transactions they perform, and bear the consequences of any payment errors or the use of unauthorized methods
Sixth – Indemnification and Commitment
- The user is committed to indemnifying and holding the Company harmless, as well as its officers, directors, employees, and agents, from any claims, damages, or losses arising as a result of their violation of these terms or misuse of the platform.
- The user’s continued use of the platform after any amendment to these terms constitutes their acceptance of and commitment to those amendments.
- The user acknowledges that all electronic transactions and contracts concluded through the platform possess full legal authority and produce their regulatory effects.
Seventh – Representation and Dealing with Parties
- The user has no right to represent the platform, speak on its behalf, or arrange any obligations on its behalf without express written authorization.
- The user is committed to refraining from direct communication with property owners, tenants, or any parties related to real estate opportunities, and to not interfering in existing contractual relationships, provided that dealings are conducted exclusively through the platform.
- The user agrees to appoint the platform as an exclusive broker regarding any shares, rights, or real estate owned through the platform, in accordance with its approved mechanisms.
- Governing Law and Dispute Resolution
- These Terms and Conditions, as well as any relationship arising from or related to them, are subject to the laws of the Kingdom of Saudi Arabia, and shall be interpreted and enforced accordingly.
- In the event of any dispute between the Company and the user, both parties are committed to attempting an amicable settlement through good-faith negotiations within a period not exceeding fourteen (14) days from the date one party notifies the other of the dispute.
- If a resolution cannot be reached within the aforementioned period, the dispute shall be referred to the competent judicial authority in the Kingdom of Saudi Arabia for adjudication.
- Intellectual Property
- ll rights related to the platform and its content – including, but not limited to – trademarks, logos, designs, text materials, images, technical systems, product structuring, as well as the Terms and Conditions, belong to the Company or its licensors, and are protected under the relevant regulations.
- The user does not acquire any ownership right in any of the platform’s elements or its content as a result of using it, and their right is limited to use within the limits permitted by law and under these terms.
- The user is granted a limited license to use the platform, which is non-exclusive, non-assignable, and non-transferable, limited to legitimate personal purposes, and does not include any commercial use or exploitation of the content.
- The user is prohibited from any copying, reproduction, modification, publication, distribution, or exploitation of any part of the platform or its content by any means whatsoever, except after obtaining prior written consent from the Company.
- In the event that the user makes available or publishes any content through the platform, they grant the Company a continuous and non-exclusive license to use, operate, and display this content for the purposes of operating, developing, or promoting the platform, without any resulting compensation, unless otherwise agreed upon.
- The Company has the right to benefit from users’ opinions, ratings, or feedback related to the platform within its media or marketing materials, provided that no personal data or identifying information is disclosed without express consent.
- Amendment of Terms and Conditions
- The Company may, at its discretion, introduce any update or amendment to these Terms and Conditions from time to time, in line with operational requirements, legal developments, or the nature of the services provided.
- In the event of material amendments, users will be notified a reasonable period before they take effect through the platform’s approved communication methods, including registered email or in-platform notifications.
- The user’s continued access to the platform or use of its services after the amendments take effect constitutes their acceptance of and commitment to all the provisions therein.
- In the event that the user does not agree to any amendment, they must stop using the platform and may terminate their account in accordance with the approved procedures.
- General Provisions
- These Terms and Conditions, along with any terms or documents specific to each real estate opportunity, represent the full and final agreement between the Company and the user regarding the use of the platform, and they supersede and replace any prior understandings or agreements, whether written or oral.
- In the event that any provision of these terms is found to be void or unenforceable, this shall not affect the validity or enforceability of the remaining provisions, which shall remain in effect and binding to the extent permitted by law.
- The user may not transfer or assign any of their rights or obligations arising from these terms except after obtaining prior written consent from the Company, whereas the Company may transfer or assign its rights and obligations to any other party without the need for the user’s consent, unless the law requires otherwise.
- The Company’s failure or delay in exercising any of its rights shall not be deemed a waiver thereof, nor shall any partial exercise of any right preclude its subsequent full exercise.
- Provisions that by their nature extend beyond the termination of the relationship shall remain in force and effect, including provisions related to confidentiality, intellectual property, limitation of liability, and indemnification.
- These terms have been prepared in Arabic and may be translated into other languages for convenience. In the event of any conflict in interpretation, the Arabic version shall prevail.
